Party Walls Notices
Helping every step of the way
We provide the relevant party wall notices so you don’t have to outsource them
A party wall notice is a formal document informing neighboring property owners about planned construction or renovation work that may impact shared walls or nearby structures. It’s a crucial legal step, and as part of our comprehensive architectural services, we include the preparation of the party wall notices
The notice seeks consent or acknowledgment of proposed works, promoting transparency and giving neighbors a chance to address concerns about disruptions, structural implications, or other relevant issues. Compliance with party wall legislation is integral to the responsible execution of architectural projects.
The step by step process
Speaking with your neighbours
Before formally serving party wall notices, we recommend initiating informal conversations with your neighbors. This proactive step not only keeps the atmosphere amicable and friendly but also provides an opportunity to address any concerns or questions they may have about the upcoming project.
Building trust and open communication from the outset ensures a smoother transition when the formal notices are served,
Serving the notices
Party wall notices are formally served to the owner of each affected property to seek their consent for upcoming construction activities. Accompanying these notices are copies of the detailed architectural drawings, providing adjoining owners with a comprehensive understanding of the proposed project.
This transparent communication allows neighbors to carefully consider the plans and make informed decisions about their response,
Neighbours Response
Once the party wall notice has been served, neighbors affected by the proposed construction have a fourteen-day window to respond.
Neighbours Consent
This consent negates the need for a formal party wall award. For comprehensive protection, engaging a party wall surveyor to assess and document the area just before construction begins offers an additional layer of assurance against potential disputes.
Neighbours Dissent
If your neighbour dissents to the notices, or does not respond in within the required timeframe. you are required to appoint a party wall surveyor to create the necessary award.
Initiating this process involves appointing an agreed surveyor. In this case we have a very experienced party wall surveyor that we would be happy to recommend.
What’s next ?
Once all necessary documentation is prepared, our administration team will organise the submittal of your building control application. While this can be done through the local council, our team often recommends opting for a private building control company.
Working with a private building control entity often results in a more personalised and responsive experience. We discuss the pros and cons of each and look at the costs of each before deciding whether to opt to work with the local authority or a private building control company operating in your area.
